X Terminates Operations in Brazil Amid Legal Conflicts Over Disinformation

X, the prominent social media platform formerly recognized as Twitter, has announced the immediate cessation of its operations in Brazil amidst an intense legal dispute with Brazilian Supreme Court Judge Alexandre de Moraes. This decision embodies the company’s ongoing tensions with the judiciary concerning its responsibilities in combating the dissemination of disinformation online. Despite the operational shutdown, Brazilian users will retain access to X.

On the announcement, made public on Saturday, representatives of X expressed their discontent, asserting that the responsibility for this action lies solely with Judge de Moraes. This development marks a significant escalation in a protracted legal confrontation, initiated earlier this year when the judge mandated X to block various accounts linked to misinformation campaigns, particularly those associated with supporters of former President Jair Bolsonaro.

Bolsonaro, who faced defeat against current President Luiz Inacio Lula da Silva in the contentious 2022 elections, had propagated unfounded claims regarding the susceptibility of Brazil’s electoral system to fraud. The situation intensified following a violent attack on state institutions by Bolsonaro’s supporters, which stemmed from election grievances. Judge de Moraes has notably stated, “Freedom of expression does not equate to freedom of aggression,” emphasizing the need for accountability and responsible communication online.

On Saturday, X alleged that Judge de Moraes covertly threatened a legal representative of the company, Rachel Nova Conceicao, with arrest if the platform did not adhere to compliance directives regarding the removal of certain content. The firm presented purported documentation implying that a daily fine of 20,000 reais (approximately $3,653), along with an arrest order, would be issued if they failed to comply. The Supreme Court of Brazil has refrained from commenting on the validity of these claims.

Elon Musk, the owner of X, described Judge de Moraes as “an utter disgrace to justice” in a separate communication on social media. He conveyed that the decision to retract the Brazilian office was challenging, arguing that acquiescence to the judge’s orders would compromise the platform’s integrity and position. Earlier in the year, a judicial inquiry was opened into Musk after he expressed intentions to restore blocked accounts, leading to a chaotic cycle of compliance and non-compliance with the legal mandates issued by the Brazilian authorities.
